2 Montreal teenagers plead guilty to child porn, sexual assault charges dropped
Girl, 14, boy, 15 pleaded guilty to producing child porn for taking cellphone video of 13-year-old girl
Two teenagers, among four accused of sexually assaulting a 13-year-old girl at an unsupervised house party in Montreal North last March, have had the charges against them withdrawn.
However, the 14-year-old girl and 15-year-old boy have pleaded guilty in Montreal's youth court to a single charge of producing child pornography, for having taken cellphone video of sexual activity involving the younger girl.
According to the Quebec Crown, the nightmarish version of events originally made public is far from what the evidence shows actually took place.
At the accused girl's bail hearing last April 27, a police officer described to the court what sounded like a night of horror for the 13-year-old complainant. The officer said the girl had wound up in the bedroom of an apartment with two boys and another girl, and the boys had held her down while the girl sexually assaulted her with an object.
The alleged incident was filmed on a cellphone and shared on social media.
In an email to Radio-Canada, Crown prosecutor Karine Destrempes said investigators later concluded that no sexual assault occurred.
"The plea came after an evaluation and analysis of all the evidence, including supplemental investigations, technological evidence, as well as the versions of everyone involved in the event," she said.
The two teens appeared in youth court on June 27 to plead guilty to the child pornography charges and were given probationary sentences.
"These guilty pleas are quite in accordance with the evidence that the Crown was able to demonstrate, in relation to the participation of these two accused in the event," said Destrempes.

According to the version of events presented in youth court, on the night of the party, the 13-year-old had sexual contact with a boy in a bedroom, while another couple were in a separate bed in the same room. One of the teens then filmed part of the scene with a cellphone.
That cellphone video is what constitutes child pornography production, since the 13-year-old is a minor.
Quebec court Judge Taya Di Pietro sentenced the 14-year-old girl to 15 months' probation. The boy faces 12 months' probation and must perform 30 hours of community service.
Both must also follow a sex education program and provide a DNA sample.
They are forbidden to go on the internet, except in the presence of an adult aware of their conviction. They must not communicate with the victim or be in her presence.
The other two co-accused will be in youth court later this summer in relation to the charges they are still facing.
